Terms and Conditions

1. Acceptance of Terms

By accessing or using Pocket Piggy ("the App", "our App", "the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and Pocket Piggy LLC ("we", "us", "our").

2. Description of Service

Pocket Piggy is a personal finance management application that helps users:

• Track income and expenses
• Create and manage budgets
• Build better saving habits
• Visualize spending patterns
• Receive financial insights and recommendations

2.1 Educational Purpose

The App is designed for personal finance education and management. It is NOT:

• A licensed financial advisor
• A tax preparation service
• A certified accounting service
• A banking or investment platform
• A credit reporting agency

3. User Eligibility

3.1 Age Requirement

You must be at least 13 years old to use this App. Users under 18 must have parental or guardian consent.

3.2 Jurisdiction

By using this App, you represent that:

• You are legally capable of entering into binding contracts
• You are not prohibited by law from using financial management services
• Your use complies with all applicable local, state, national, and international laws

4. User Account and Security

4.1 Account Creation

You must provide:

• A valid email address
• A secure password
• Accurate personal information

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4.2 Account Security

We implement industry-standard security measures including:

• AES-256 encryption for data at rest
• Secure data transmission (TLS/SSL)
• Biometric authentication options
• Two-factor authentication (where available)

YOU ARE SOLELY RESPONSIBLE FOR:

• Choosing a strong, unique password
• Keeping your password confidential
• Securing your device
• Logging out when using shared devices

4.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Provide false or misleading information
• Engage in fraudulent activity
• Attempt to compromise the security of the App
• Use the App for illegal purposes

5. Financial Data and Privacy

5.1 Data You Provide

You voluntarily provide financial data including:

• Income and expense transactions
• Budget information
• Account balances (manually entered)

5.2 Data Storage

• All financial data is stored encrypted on your device
• Non-financial data (profile, gamification progress) is synced to Firebase with encryption in transit and at rest
• We do NOT store your banking login credentials (Plaid handles bank authentication securely)
• Bank-synced transaction data is staged locally on your device before import

5.3 Data Accuracy

YOU ARE RESPONSIBLE FOR:

• Accuracy of all data entered into the App
• Regular review and verification of your financial data
• Making financial decisions based on your own analysis

WE DO NOT GUARANTEE:

• The accuracy of calculations or projections
• The completeness of financial insights
• The suitability of recommendations for your specific situation

6. Intellectual Property Rights

6.1 Our Property

The App and its original content, features, and functionality are owned by Pocket Piggy and are protected by:

• Copyright laws
• Trademark laws
• Patent laws
• Trade secret laws
• Other intellectual property rights

This includes but is not limited to:

• Source code
• Design elements
• Logos and branding
• Mascot characters and artwork
• Documentation

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

6.3 Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for commercial purposes without written permission
• Sell, rent, lease, or sublicense access to the App
• Use automated systems (bots, scrapers) to access the App

7. User-Generated Content

7.1 Your Data Ownership

You retain ownership of all financial data and content you create in the App.

7.2 License to Us

By using the App, you grant us a limited license to:

• Store and process your data to provide the Service
• Create aggregated, anonymized data for analytics
• Use feedback you provide to improve the App

7.3 Prohibited Content

You may NOT use the App to store or transmit:

• Illegal content
• Content that violates intellectual property rights
• Malicious code or viruses
• Content that could harm minors
• Spam or unsolicited communications

8. Third-Party Services

8.1 Firebase and Google Services

We use Google Firebase for:

• User authentication
• Cloud data storage
• Analytics
• Crash reporting

Your use of Firebase services is subject to Google's Terms of Service.

8.2 Plaid (Bank Sync)

Pro subscribers may connect bank accounts via Plaid Inc.:

• Plaid securely handles your bank login credentials — we never see or store them
• Transaction data retrieved through Plaid is staged locally on your device for your review before import
• You may unlink your bank account at any time from Account Settings
• Your use of Plaid is subject to Plaid's End User Privacy Policy

8.3 RevenueCat (Subscriptions)

In-app purchases and subscription management are handled by RevenueCat:

• Payment processing is handled by Apple App Store and Google Play
• We do not store or have access to your payment card details
• Your use of RevenueCat is subject to RevenueCat's Terms

8.4 AI Categorization (OpenAI)

Pro subscribers may opt in to AI-assisted transaction categorization:

• Only merchant names and approximate amounts are sent to OpenAI for categorization
• No exact amounts, account numbers, or personally identifiable information is shared
• AI is used only as a fallback when other methods (merchant cache, pattern rules, bank hints) cannot determine a category
• You may enable or disable AI categorization at any time from Sync Settings
• A consent dialog is shown before AI categorization is first used

8.5 Other Third-Party Services

• exchangerate.host: Currency exchange rates (no personal data shared)
• Google Gemini: AI-generated images for financial tips (no personal data shared)
• Firebase Cloud Functions: Server-side processing for Plaid data retrieval (encrypted in transit)

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness
• Uninterrupted or error-free operation

9.2 No Financial Advice

You should consult with qualified professionals for:

• Tax preparation and filing
• Investment decisions
• Legal matters
• Complex financial planning

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption
• Financial losses resulting from use of the App
• Errors or inaccuracies in financial calculations
• Decisions made based on App data or recommendations
• Inaccuracies in financial projections, forecasts, or end-of-month estimates

THIS INCLUDES DAMAGES ARISING FROM:

• Your reliance on the App
• Errors in data entry or calculation
• Software bugs or malfunctions
• Unauthorized access to your account
• Data loss or corruption
• Service interruptions

MAXIMUM LIABILITY: Our total liability shall not exceed the amount you paid us in subscription fees in the past 12 months.

9.4 Data Loss

While we implement backup systems:

• We do NOT guarantee against data loss
• You are responsible for maintaining your own backups
• We recommend exporting your data regularly
• We are not liable for lost, corrupted, or inaccessible data

10. Indemnification

You agree to indemnify, defend, and hold harmless Pocket Piggy, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws
• Any financial decisions made based on App data
• Inaccurate information you provide

11. Changes to the Service

11.1 Right to Modify

We reserve the right to:

• Modify or discontinue features
• Change pricing (with notice)
• Update the App with new versions
• Perform maintenance and updates

11.2 Notice of Changes

We will provide reasonable notice of material changes:

• In-app notifications
• Email notifications
• Updates to these Terms

11.3 Your Options

If you disagree with changes:

• You may stop using the App
• You may export your data before discontinuing use
• Continued use constitutes acceptance of changes

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

• Using the in-app account deletion feature
• Contacting us at support@pocketpiggy.app
• Uninstalling the App (note: this does not delete cloud data)

12.2 Termination by Us

We may terminate or suspend your account if:

• You violate these Terms
• Your account is inactive for an extended period
• Required by law or legal process
• We discontinue the Service

12.3 Effect of Termination

Upon termination:

• Your access to the App will cease
• Your data may be deleted after a grace period
• You should export your data before termination
• These Terms survive termination where applicable

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

13.2 Arbitration Agreement

By using the App, you agree to:

• Waive your right to a jury trial
• Waive your right to participate in class action lawsuits
• Resolve disputes individually through arbitration

13.3 Exceptions to Arbitration

You may opt out of arbitration by:

• Sending written notice within 30 days of first use

• Including your name, address, and username

13.4 Informal Resolution

Before filing arbitration or court action:

• Contact us at support@pocketpiggy.app
• We commit to good-faith resolution attempts
• Allow 60 days for informal resolution

14. Miscellaneous Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pocket Piggy.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer your account or these Terms. We may assign these Terms without restriction.

14.5 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control.

14.6 Export Controls

You may not use the App in violation of export laws and regulations.

16. Updates to Terms

We may update these Terms periodically. We will notify you of material changes by:

• Posting the new Terms in the App
• Sending email notification
• Updating the "Last Updated" date

Your continued use after changes constitutes acceptance of the new Terms.

17. Additional Terms for Specific Features

17.1 Biometric Authentication

If you enable biometric authentication:

• Biometric data is stored locally on your device
• We do NOT have access to your biometric data
• You are responsible for biometric security
• Anyone with enrolled biometrics on your device can access the App

17.2 Cloud Backup

If you enable cloud backup:

• Data is encrypted end-to-end
• Stored in Google Firebase
• Subject to Google's terms and policies
• May count against your Google storage quota

17.3 Data Export

You have the right to:

• Export all your data at any time
• Receive data in a machine-readable format (CSV, JSON)
• Use exported data with other services

17.4 Subscriptions and In-App Purchases

Pocket Piggy offers subscription tiers (Free and Pro):

• Subscriptions are billed through Apple App Store or Google Play
• Subscription auto-renews unless cancelled before the renewal date
• You may cancel at any time; access continues until the end of the current billing period
• Downgrades take effect at the end of the current billing period
• Refunds are handled by Apple or Google per their respective policies
• We reserve the right to change pricing with reasonable notice

17.5 Analytics and Improvement

We collect anonymized, aggregated data to:

• Improve app performance
• Understand feature usage
• Fix bugs and crashes
• Develop new features

This data CANNOT be traced back to you individually.
